Copyright protects “original” work of authorship that are “fixed” in a tangible medium of expression.  It includes literary, musical, and dramatic works; photographs; graphics; audio and visual recordings; software; and other creative works.  Copyright derives from the United States Constitution and codified by federal statute.   Copyrights can be protected and enforceable in many foreign jurisdictions under various international treaties.

EmergeCounsel liberally utilizes copyright protection to ensure original elements such as:

  • Product packaging design and art
  • Product directions and other instructional materials
  • Websites
  • Advertising Literature
  • Product design (e.
  • Service provider forms and content
  • Videos such as commercials
  • Blogs
  • Podcasts

Copyright prosecution and registration costs are relatively low as compared to other IP protection strategies.  Copyright secures intangible assets which can significantly increase the value of any company. For example, IBM has reported near $4 billion intangible assets under ownership.  For entrepreneurs, registered copyright also creates enforceable barriers against infringers.

EmergeCounsel Works Strategically with Its Business Clients to Protect Copyright

Generally, we work with our clients to conduct an efficient review of products and/or services and related marketing collateral.    We then create a strategy to maximize Copyright protection with as few filings as possible. Finally, we assure that any copyright secured is memorialized and organized.  We also work with our clients on rights clearance (such as “work for hire” agreements).
